Successful action against two Unauthorised Occupiers

The Housing Management team at Partners has recently regained possession of two properties from unauthorised occupiers, following legal proceedings.

In both cases the tenant’s of the property passed away but applications to succeed to the tenancy were received.
 
In the first case an individual claimed that he had been living with the tenant as her partner at the time of her death and applied to succeed to the tenancy. He was however unable to evidence this, and our enquiries with other family members suggested that the individual was not known to them, and had not been the tenants partner. Following lengthy legal proceedings, which the unauthorised occupier defended,  the County Court awarded a Full Possession Order on 11 February 2010, and the Court bailiff executed the eviction warrant, and Partners gained possession of the property, on 26 March 2010.
 
In the second case, the person who applied to succeed was also unable to evidence their eligibility to succeed and Partners issued possession proceedings. The County Court awarded a Full Possession Order on 20 January 2010, and the Court Bailiff executed the eviction warrant, and Partners gained possession of the property, on 8 April 2010.
 
Partners’ Housing Management team take all reports of Unauthorised Occupation very seriously and actively investigate them
